1. Service Description

Ayarla is a SaaS (Software as a Service) platform that enables barber shops and beauty salons to manage appointments automatically via WhatsApp. Our services include:

  • Automatic appointment booking via WhatsApp Business API integration
  • Appointment confirmation, cancellation, and reminder notification system
  • Salon management dashboard (appointment calendar, staff, service, and customer management)
  • Customer communication and appointment history tracking

2. Account Creation and Responsibilities

2.1 Account Requirements

  • You must be at least 18 years old to use the platform
  • You are required to provide accurate and up-to-date information during registration
  • Only one account may be created per business
  • You are responsible for the security of your account credentials

2.2 Salon Owner Responsibilities

  • Comply with Meta policies regarding WhatsApp Business accounts
  • Take responsibility for the content of messages sent to customers
  • Keep business information up to date
  • Be responsible for all actions performed through the platform
  • Act in compliance with KVKK (Turkish Personal Data Protection Law) and relevant regulations

3. Subscription and Payment

3.1 Plans

Ayarla offers three different subscription plans:

  • Starter: Basic features, 1 staff member
  • Pro: Advanced features, up to 5 staff members, reminders and analytics
  • Premium (Enterprise): Unlimited staff, custom message templates, 24/7 priority support

3.2 Payment Terms

  • Subscription fees can be paid monthly or annually
  • Discounted pricing is available for annual plans
  • Payments are processed through a Paddle payment infrastructure
  • Prices are in Turkish Lira (TRY) and include VAT
  • Price changes will be communicated at least 30 days in advance

3.3 Cancellation and Refunds

  • You may cancel your subscription at any time
  • After cancellation, you will continue to receive service until the end of the current billing period
  • No pro-rata refunds are provided for unused time
  • Full refunds are available for cancellations made within the first 14 days

4. Acceptable Use

You must comply with the following rules when using our platform:

4.1 Prohibited Uses

  • Sending spam or unsolicited bulk messages
  • Violating WhatsApp Business policies
  • Using the platform for illegal purposes
  • Attempting unauthorized access to other users' data
  • Performing actions that compromise platform security
  • Reverse engineering, decompiling, or copying source code
  • Reselling or sublicensing the platform
  • Using automated tools or bots to misuse the platform

4.2 WhatsApp Compliance

Our platform operates through the Meta WhatsApp Business API. Users are required to comply with Meta's WhatsApp Business Policy and Commerce Policy. In case of violation, both your Meta and Ayarla accounts may be suspended.

5. Intellectual Property

  • The Ayarla platform, logo, design, and source code are the intellectual property of Ayarla
  • Users retain ownership of business data entered through the platform
  • Ayarla reserves the right to process user data for service delivery
  • Ayarla does not claim any ownership rights over user content

6. Service Level

6.1 Uptime Guarantee

Ayarla aims for the platform to be accessible at least 99.5% of the time per month. Scheduled maintenance is not included in this calculation and will be announced at least 24 hours in advance.

6.2 Support

  • Starter and Pro: Email support (business days, response within 24 hours)
  • Premium: Priority support (24/7, response within 4 hours)

7. Limitation of Liability

  • Ayarla is not responsible for service disruptions caused by WhatsApp or Meta
  • No liability is accepted for issues caused by third-party service providers (Supabase, etc.)
  • The platform is provided "as is" without warranties of merchantability or fitness for a particular purpose
  • Ayarla's total liability shall not exceed the subscription fees paid in the last 12 months
  • No liability is accepted for indirect, incidental, special, or punitive damages

8. Account Termination

8.1 By User

  • You may close your account at any time
  • When an account is closed, your data will be permanently deleted within 30 days
  • Data subject to legal retention obligations is excluded from this timeframe

8.2 By Ayarla

We reserve the right to suspend or terminate your account in the following cases:

  • Violation of these terms
  • Violation of WhatsApp Business policies
  • Failure to fulfill payment obligations (after a 30-day grace period)
  • Engagement in illegal activities
  • Negatively affecting other users' experience

9. Data Portability

If you close your account, you may request a copy of your data within 30 days from the date of termination. Your data will be provided in JSON or CSV format.

10. Dispute Resolution

  • These terms are governed by the laws of the Republic of Turkey
  • In case of disputes, an amicable resolution will be sought first
  • If no agreement is reached, the Courts and Enforcement Offices of Istanbul shall have jurisdiction
  • Rights arising from consumer protection legislation are reserved

11. Changes

We may update these Terms of Service from time to time. Significant changes will be communicated at least 30 days in advance via email or platform notification. Your continued use of the platform after changes constitutes acceptance of the updated terms.

13. Miscellaneous

  • If any provision of these terms is deemed invalid, it shall not affect the validity of the remaining provisions
  • Ayarla's failure to exercise a right shall not constitute a waiver of that right
  • These terms constitute the entire agreement between the parties and supersede all prior oral or written agreements
